Cancellation policy (§7 AGB)

1. scope of application

   1. 1.1 The following general terms and conditions apply exclusively to the business relationship between the customer and DEPARTMENTGREEN GMBH [GG&L].
   2. 1.2 The General Terms and Conditions in the version valid at the time of the contract become part of the contract.
   3. 1.3 We sell our goods exclusively to end consumers and only in normal household quantities.

2. Copyright and Industrial Property Rights

   1. 2.1 The contents of this website are legally protected. It is forbidden to reproduce, distribute or use for commercial purposes any material protected by copyright, trademark law, competition law or any other way, in particular texts, images, graphics, software, videos, music, brands, logos and other company identifiers, without prior written consent use.
   2. 2.2 Insofar as content is made available for download by GG&L, no rights of use are granted that go beyond the specific purpose of use on which the download is based.

   2. 3.2 Saving the text of the contract: We save the text of the contract and send you the order data and our general terms and conditions by e-mail. You can view the General Terms and Conditions here at any time. For security reasons, your order data is no longer accessible via the Internet.

4. Conclusion of contract/ terms of delivery

   1. 4.1 The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue.
   2. 4.2 By clicking the "buy now" button, you place a binding order for the goods contained in the shopping cart, which represents the offer to DEPRTMENTGREEN GMBH.
   3. 4.3 The confirmation of receipt of the order follows immediately after the order has been sent.
   4. 4.4 We may accept your order by sending you an order confirmation email.
   5. 4.5 The risk of damage passes to the customer when the goods are handed over to the customer, otherwise when the customer is in default of acceptance.

5. Right of withdrawal

   1. 5.1 Right of Withdrawal
      You have the right to withdraw from this contract within 30 days without giving any reason. The cancellation period is 30 days from the day on which you or a third party named by you who is not the carrier took possession of the goods. In order to exercise your right of cancellation, you must notify DEPARTMENTGREEN GmbH

      by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can use the attached withdrawal form for this, but it is not mandatory. You can also electronically fill out and submit the revocation form or any other clear declaration on our website (shop.george-gina-lucy.com/shop/de). If you make use of this option, we will immediately send you (e.g. by e-mail) confirmation of receipt of such a revocation. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

   2. 5.2 Consequences of revocation:
      1. a) If you withdraw from this contract, we will owe you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you choose a different type of delivery than the one offered by us, cheap have chosen standard delivery) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.
      2. b) We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
      3. c) You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of thirty days has expired.

6. payment

   1. 6.1 The prices are given in euros including statutory sales tax. The payment options available to the customer are PayPal, payment by immediate transfer and credit card
   2. 6.2 Payment by credit card is only permitted if the customer is also the owner of the credit card. If this payment method is selected, DEPARTMENTGREEN GMBH is authorized to charge the credit card account when ordering the goods.
   3. 6.3 Please note that Klarna invoices are only available to consumers and that payments must be made to Klarna in each case. When buying on account with Klarna, you always get our goods first and you always have a payment period of 14 days. The complete terms and conditions for purchase on account can be found here .

7. warranty

   1. 7.1 Deviations in structure and color are reserved insofar as these are in the nature of the materials used and are customary in the trade.
   2. 7.2 When asserting warranty rights, the defectiveness of the item must be pointed out and, in contrast to the right of return (see § 5), it must be stated whether a replacement delivery is desired. The right of return according to § 5 of the present contractual conditions also applies in the event of a warranty.

8. assignment

   1. Claims against DEPARTMENTGREEN GMBH may not be assigned.

10. Final Provisions

    1. The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention.

11. retention of title

    1. 11.1 The delivered goods remain the property of DEPARTMENTGREEN GMBH until the claim against the customer arising from this purchase contract has been settled in full.
    2. 11.2The customer is obliged to treat the goods with care during the existence of the retention of title.
    3. 11.3 He must notify DEPARTMENTGREEN GMBH immediately of a change in ownership of the goods and a change of address.
